Свободная экономическая зона создается и ликвидируется решением Жогорку Кенеша Кыргызской Республики с учетом мнения местных государственных администраций и органов местного самоуправления. Граница свободной экономической зоны, порядок и сроки ее действия определяются Жогорку Кенешем Кыргызской Республики. Положение о каждой свободной экономической зоне утверждается Правительством Кыргызской Республики. Генеральная дирекция СЭЗ, как юридическое лицо, является субъектом свободной экономической зоны.
