В тех случаях, когда супруги или один из них зарегистрировали брак
без намерения создать семью, брак может быть признан
недействительным (фиктивный брак).
Брак не может быть признан фиктивным, если лица,
зарегистрировавшие этот брак, до рассмотрения дела судом фактически
создали семью.
Требование о признании брака недействительным, как фиктивного,
вправе предъявить прокурор, а в тех случаях, когда лишь один из
супругов вступил в брак без намерения создать семью, такое требование
может быть предъявлено также другим супругом.
