I. Судья, принимавший участие в рассмотрении дела, не может
участвовать в рассмотрении этого дела в суде другой инстанции.
II. Судья, принимавший участие в рассмотрении дела в первой или
апелляционной инстанции, не может участвовать в повторном
рассмотрении этого дела в той же инстанции, кроме случаев
рассмотрения дел по вновь открывшимся обстоятельствам.
