(1) Суд обязан при постановлении приговора обсудить вопрос о вменяемости подсудимого. (2) Признав, что подсудимый во время совершения деяния находился в невменяемом состоянии или после совершения преступления заболел неизлечимой душевной болезнью, лишающей его возможности осознавать фактическое значение своих действий, их вредность или руководить ими, суд выносит постановление о прекращении уголовного дела и применении к нему принудительных мер медицинского характера. (В редакции Закона КР от 8 августа 2004 года № 111) Законом КР 10 августа 2012 года № 164 внесены изменения в статью 313, изложенную на государственном языке
