Суд вправе отклонить иск кредитора о ликвидации предприятия в
случае несоблюдения кредитором требований части первой статьи 4
настоящего Закона при подаче иска.
При отклонении иска суд выносит мотивированное определение,
одновременно решая в нем вопросы об отсутствии или наличии ущерба,
причиненного предприятию в результате подачи необоснованного иска,
размерах этого ущерба и сроках его возмещения кредитором.
Суд не вправе отклонить заявление о ликвидации самого предприятия
или его владельцев.
