1. В случаях, когда в соответствии с договором банковского счета банк осуществляет платежи со счета несмотря на отсутствие денежных средств (кредитование счета), банк считается предоставившим клиенту кредит на соответствующую сумму со дня осуществления такого платежа.
2. Права и обязанности сторон, связанные с кредитованием счета, определяются правилами о кредите (глава 34), если договором банковского вклада не предусмотрено иное.
