1. В случае явки или обнаружения места пребывания гражданина, признанного безвестно отсутствующим, суд отменяет решение о признании его безвестно отсутствующим. На основании решения суда отменяется управление имуществом этого гражданина.
2. Если по истечении трех лет со дня назначения управляющего решение об объявлении лица безвестно отсутствующим не было отменено и не было обращения в суд о признании гражданина умершим, территориальное подразделение уполномоченного государственного органа по защите детей обязано обратиться в суд с заявлением о признании гражданина умершим.
