Под несанкционированным разглашением коммерческой тайны понимаются умышленные действия работников хозяйствующего субъекта, располагающих сведениями, составляющими коммерческую тайну, или других физических и юридических лиц, имеющих доступ к коммерческой тайне либо незаконно получивших сведения, составляющие коммерческую тайну, повлекшие за собой их преждевременное открытие и бесконтрольное использование или распространение, в результате чего нанесен или может быть нанесен ущерб интересам хозяйствующего субъекта.
