К эмигрантам не относятся сотрудники посольств и представительств Кыргызской Республики в зарубежных странах, граждане Кыргызской Республики, осуществляющие в зарубежных странах временную трудовую деятельность, военнослужащие, выполняющие миротворческую миссию, а также лица, находящиеся на учебе, лечении, в туристической поездке, по приглашению организации и частных лиц и в служебной командировке в зарубежных странах. К эмигрантам также не относятся и другие лица, временно выехавшие из Кыргызской Республики.
