Если какое-либо из требований, по которым ответственность судовладельца может быть ограничена, предъявлено непосредственно лицу, за действия и упущения которого судовладелец отвечает, это лицо может воспользоваться правом ограничения ответственности, установленным для судовладельца, если не доказано, что ущерб причинен указанным лицом умышленно.
