1. Сервитут может устанавливаться по соглашению сторон (добровольный сервитут) или, в случае необходимости, на основании решения уполномоченного органа (принудительный сервитут).
2. Обременение земельного участка сервитутом не лишает собственника земельного участка или землепользователя права пользоваться и распоряжаться земельным участком.
