Размер денежных средств, подлежащих взысканию с военнослужащего для возмещения причиненного ущерба, может быть снижен судом с учетом конкретных обстоятельств, степени вины и материального положения воен- нослужащего, за исключением случаев, предусмотренных абзацем четвертым статьи 5 настоящего Закона.
