1. Лица, участвующие в деле, должны доказать те обстоятельства, на которые они ссылаются как на основания своих требований и возражений.
2. Суд определяет, какие обстоятельства имеют значение для правильного разрешения дела на основании требований и возражений лиц, участвующих в деле, с учетом подлежащих применению норм права.
