Заявление или представление о пересмотре судебного акта по вновь открывшимся обстоятельствам суд рассматривает в судебном заседании в месячный срок со дня его поступления. Заявитель и другие лица, участвующие в деле, извещаются о времени и месте судебного заседания, однако их неявка не является препятствием к рассмотрению заявления или представления.
