Обстоятельством, исключающим виновность физического лица, признается совершение противоправного деяния лицом, которое не могло осознавать свое действие (бездействие) и руководить им вследствие хронического психического заболевания, временного душевного расстройства, слабоумия или другого болезненного состояния психики.
