Исполнителем является лицо, непосредственно совершившее преступление или непосредственно участвовавшее в его совершении совместно с другим лицом (соисполнителем), а равно лицо, совершившее преступление посредством другого лица, не подлежащего согласно настоящему Кодексу уголовной ответственности в силу возраста, невменяемости или иных обстоятельств.
