1. До допроса свидетеля председательствующий устанавливает личность свидетеля, разъясняет его обязанности и права и предупреждает его об ответственности за отказ от дачи показаний и за дачу заведомо ложных показаний, о чем отбирается подписка, которая приобщается к делу.
2. Свидетелю, не достигшему шестнадцатилетнего возраста, председательствующий разъясняет обязанность правдиво рассказать все известное ему по делу, но он не предупреждается об ответственности за отказ от дачи показаний и за дачу заведомо ложных показаний.
