1. Субъектом применения закона об амнистии является судья (суд) - по уголовному делу, находящемуся в его производстве или по поступившим материалам из уполномоченного органа, исполняющего наказание.
2. При рассмотрении в судебном заседании вопроса о применении закона об амнистии обязательно участие прокурора.
