Лицо, отбывающее наказание в виде содержания в дисциплинарной воинской части и признанное военно-врачебной комиссией негодным по состоянию здоровья к военной службе с исключением с учета или негодным в мирное время, подлежит по решению суда освобождению от наказания досрочно либо с заменой неотбытой части наказания более мягким.
